How does botox work?
Botox is administered by diluting botulinum powder in saline and injecting it directly into neuromuscular tissue.
Around 12-20 injections are given in the vertical lines between the eyebrows and the crow’s feet wrinkles around the patient’s eyes. The procedure takes about 30-45 minutes.
Botox works by blocking the release of the neurotransmitter acetylcholine - the chemical messenger that tells muscles to contract. Over time, the nerves gradually rebuild the ability to release the chemical messenger and the muscles eventually regain their ability to function. The effects of botulinum toxin injections last for between two and six months.
The Botox toxin is also sometimes injected into the neck, the jaw and the armpits to treat excessive sweating.

What can go wrong?
While Botox continues to grow in popularity as a non-surgical aesthetic treatment, there is also a concerning rise in the number of cases where the procedure goes wrong, leaving people who undergo treatment in considerable distress.
In the majority of instances, Botox injections are administered safely, delivering the intended cosmetic results. However, when mistakes occur - whether due to too much Botox being injected, incorrect technique, counterfeit product or application in the wrong location - the consequences can be both physically and emotionally damaging.
Indications that a Botox treatment may have been carried out negligently can be serious and include:
- Difficulty breathing: particularly after injection into the throat if Botox impacts nearby muscles.
- Difficulty eating: as a result of muscle weakness or paralysis in the jaw or surrounding regions.

What is my botox practitioner's duty of care?
Your Botox practitioner has a clear legal duty of care to prioritise your health, safety and wellbeing throughout the entire treatment process. This duty exists to reduce the risk of avoidable complications and to ensure that every step of your care is delivered to an appropriate clinical standard.
- At the consultation stage, your practitioner must take time to understand your expectations and medical history. They should clearly explain what the Botox treatment involves, including potential risks and outcomes. You must be confirmed as over the age of 18, and your informed consent should be obtained before any treatment goes ahead.
- During the procedure, your practitioner is required to use correct injection techniques, appropriate equipment and maintain a sterile environment. The Botox must be administered precisely to the agreed areas, in line with what was discussed during your consultation.
- After treatment, you should receive thorough aftercare advice, and your practitioner should remain available to monitor your recovery. They must also be able to recognise early signs of complications and take prompt steps to address any concerns.
If a practitioner fails in any part of this duty of care and you experience complications as a result, you may be entitled to pursue a Botox compensation claim.

FAQs about botox compensation claims
How much compensation can I get from a Botox claim?
When making a cosmetic surgery compensation claim on your behalf, we will aim to secure two types of compensation for you: general and special damages.
General damages take into consideration the pain and suffering - including psychological harm - that your surgeon’s negligence caused you. Special damages are calculated based on any costs that you incurred due to your injury, including money spent on private medical treatment and support, and lost wages if you were unable to work while you recovered.
The amount of compensation you will receive for a successful Botox compensation claim can vary considerably depending on these factors. Your solicitor will be able to give you an estimate of how much you may be able to claim based on the nature of your injury and the expenses you have incurred. Learn more about how cosmetic surgery compensation is calculated.
Am I eligible to make a Botox compensation claim?
You will be eligible to make a Botox compensation claim if your surgeon acted with negligence that caused a problem with your cosmetic procedure or led to your suffering.
Proving this failure to meet their duty of care is the first part of eligibility for a Botox negligence claim.
Secondly, you must prove that you suffered avoidable complications directly due to your surgeon's negligence. This is called proving 'causation', and it can be evidenced by any physical injury, psychological trauma or financial losses you incurred. During your Botox injury claim, your solicitor will consider how these factors had an effect on your life and how much compensation you will need to pay for to get the care and support you require to make a recovery.
To find out whether you are eligible to claim compensation for a Botox injury due to negligence, call us as soon as possible. We will discuss your situation and inform you of whether you can claim, what your chances of success are and how much compensation you may be able to claim.
Can I make a claim for Botox compensation if I am unhappy with the results of my procedure?
To make a claim for clinical negligence, you must be able to prove that you were treated with substandard care and that you were caused harm in some way, either due to physical injury, psychological trauma or in financial losses due to not being able to work. You will not be able to make a Botox treatment claim if your surgeon fulfilled their duty of care but you are just unhappy with the results of your procedure.
Are there time limits on Botox compensation claims?
You will have three years from the date of the event where you experienced negligence to make your Botox compensation claim. You should contact us as soon as you are healthy enough to do so, so we can start to gather evidence and build your case. The sooner we can begin this process, the better chance you will have of success with your compensation claim.
What is the process of making a Botox compensation claim?
The first step in making a cosmetic surgery claim is to call us. We will discuss your situation and outline the best course of action. From there, we will gather evidence about the circumstances of your case that will allow us to prove the negligence you experienced in court.
During this time, we will help you to find any medical care you require so you can start your recovery while we work on your case.
Once we have gathered substantial evidence, we will approach the opposing party and inform them that a compensation claim is being made against them. At this point, they may either choose to settle and negotiate with us to reach a fair compensation sum, or they will dispute the claim.
If the other party disputes the compensation claim, court proceedings will ensue. We will represent you throughout these proceedings, presenting our argument and evidence to the court. If we are successful, the court will usually rule that the opposing party must pay your compensation amount and your legal fees.
You can then use these finances to pay for any medical care and support you paid for during your recovery, or any that you need in the future as a result of your injury. This includes psychological care.
What is Botox?
The Botox substance is a toxin made from a type of bacteria called clostridium botulinum. It is used in a number of medical supplies to help treat chronic migraines and certain muscle issues, including spasms and cerebral palsy. It also has a use for removing wrinkles on the forehead area through being injected under the skin. It is generally a safe substance, but it is always used in very small doses and excessive usage could be dangerous.
How can a solicitor help me with botched Botox treatment?
An expert plastic surgery solicitor from Cosmetic Surgery Solicitors will be able to support you throughout the entire process of making a compensation claim. We will work to get you the compensation payout that you need and deserve from the get-go.
When you call us, our Botox compensation claims solicitors will discuss your situation and will inform you as to whether you will be able to make a claim, what your chances of success are, how much you may be able to claim and what you will need to do next.
In most cases, we will be able to gather the necessary evidence for you. However, we will facilitate medical professionals to provide statements to support your claim, and you may need to be present so they can get a good idea of your circumstances.
Once we have a strong case, we will present it to the negligent party, communicating with everyone involved on your behalf and keeping you informed of the progress.
In many cases, claims can be settled without court proceedings being necessary, and we will always strive to achieve this. However, if the negligent party disputes the claim, court proceedings will be necessary. Do not worry - you will not be required to appear in court. Instead, your solicitor will represent you, presenting your evidence as an argument for why you deserve compensation.
What types of evidence will I need to claim Botox compensation?
First, do not worry about how you will gather evidence for your claim - your solicitor will identify this for you and will be able to collect most of it on your behalf. You may be required to provide some statements or consult with a medical expert, but we will arrange this for you so it is as stress-free as possible, allowing you to focus on your recovery.
The key forms of evidence that we will collect to support your case include:
- Medical reports from an independent medical assessment, such as from your GP, and psychological reports from a therapist.
- Witness statements from your family and friends, or other people who may have witnessed your struggle with the results of your Botox procedure.
- Photographs of your Botox injuries.
- Financial reports that show your earnings and expenses.
What types of injuries can stem from negligent Botox treatment?
Botched Botox treatment may result in a number of injuries that may cause physical pain or lead you to feel anxious or depressed. These include:
- Difficulty breathing
- Difficulty eating
- Emotional distress
If you are suffering from any of these issues and believe it could be due to the negligence of your cosmetic surgeon, speak to our team today to find out what you may be able to do.
How much does it cost to make a compensation claim?
We handle all claims on a no win, no fee basis. This means that if your claim is not successful, you will not be required to pay our legal fees - removing the financial risk of pursuing compensation.
If your case is successful, the other party will cover our basic legal costs in addition to your compensation. You will only be responsible for a success fee, which is agreed with you in advance and will never exceed 25% of the compensation you receive.
There may be other charges involved, such as the cost of expert medical reports or insurance to protect against legal expenses. We will explain all potential costs clearly and transparently before you decide to begin your claim, so you can make an informed choice with confidence.
