What is the definition of negligence?

Negligence is defined as conduct that falls below the standard of behaviour that has been established by law in order to protect others against the unreasonable risk of harm. Anything below this standard is seen as acting negligently.

A failure to conform to a required standard of conduct or behaviour will form the basis of any claim for negligence, alongside proof that someone was harmed as a result and that negligence was the cause of harm.

Is there a time limit for making a claim?

Yes there is. This stands at three years after you discover that you were the victim of negligence.

However, if the victim of negligence was under 18 when it occurred, the 3 years start from their 18th birthday. If the victim is suffering from mental health issues then the 3 year limit will commence from their recovery.

Do I have to go to court?
